Records requests under section 36: what to keep, what to show, how fast

Owners, tenants (for some records) and their authorised representatives have a statutory right to the strata's records. Managing that right well is mostly about keeping the records in order before anyone asks.

What must be kept (s.35)

  • Minutes of council and general meetings, including vote results.
  • Financial statements, budgets, bank statements and invoices.
  • Bylaws and rules, the registered strata plan and amendments.
  • Correspondence sent or received by the strata and council.
  • Written contracts, insurance policies, depreciation reports and engineering reports.
  • Owner and tenant lists, Form K notices, Information Certificates issued, and the records of hearings and bylaw enforcement.

The strata may charge a copying fee up to the Regulation's per-page maximum (currently $0.25 per page) and may provide records electronically. Personal information of other owners and residents that is not required to be disclosed should be redacted.

Can the strata refuse to show legal opinions?

Records subject to solicitor-client privilege may be withheld; most other records must be produced.

Can an owner see bylaw complaint files about other units?

Enforcement records are strata records, but personal information of other residents should be protected; provide the record with appropriate redactions.

Do email exchanges between council members count?

Correspondence sent or received by council on strata business is a record the strata must keep.
