Form K: the notice every tenant in a BC strata must receive

When a strata lot is rented, the tenant becomes bound by the bylaws and rules — and the Act makes sure they know it. The Form K Notice of Tenant's Responsibilities is that mechanism, and the strata is entitled to a copy within two weeks.

What section 146 requires

  • Before a tenant occupies the lot, the landlord must give the tenant the current bylaws and rules and a Notice of Tenant's Responsibilities in the prescribed form (Form K).
  • The landlord must give a copy of the signed Form K to the strata corporation within two weeks of renting the lot.
  • A tenant is bound by the bylaws and rules whether or not the Form K was delivered — the notice creates awareness, not the obligation.

Why the strata cares

A tenant who has received the Form K cannot claim ignorance of the bylaws when a complaint is raised, and the strata has the landlord's confirmation on file. It also tells the strata who is living in the building, which matters for emergency contact, fobs and parking, and for the Form B disclosure of rentals.

Since the 2022 amendments removed rental-restriction bylaws (other than short-term rental and age restrictions), the Form K is the primary tenancy record most stratas hold. Keeping it current is now the compliance job, not policing rentals.

A practical workflow

  1. 1.Treat every move-in as the trigger: when a tenant books the elevator, ask for the Form K.
  2. 2.Store the signed form on the unit with the tenancy start date and the landlord's contact.
  3. 3.Update the directory so notices reach the tenant and the owner correctly.
  4. 4.Review the registry quarterly for tenancies with no Form K on file and remind the owner.

Can the strata fine a landlord for not providing the Form K?

Only if a bylaw provides a fine for that contravention and the s.135 steps are followed. Many stratas rely on reminders and the elevator-booking trigger instead.

Does a short-term guest need a Form K?

The Form K is for tenancies. Short-term accommodation is governed by the strata's short-term rental bylaws and provincial and municipal rules.

Who signs the Form K?

The tenant signs the acknowledgement; the landlord provides it and delivers the copy to the strata.
